Non-Disclosure Agreement Terms

This agreement is governed by and will be construed in accordance with the laws of Victoria, Australia.

The effective date of the NDA is from the moment a beta tester agrees to the terms of this NDA by joining the Testers on the Twice Different Discord Server or playing a pre-release test build of the game, until the end of their engagement with Twice Different.

CONFIDENTIALITY AGREEMENT

The Tester acknowledges that Confidential Information that is disclosed to or comes into the possession of the Tester in connection with testing the game is highly confidential and the proprietary information of Twice Different.

The Tester must at all times:

(a) keep the Confidential Information strictly confidential and not make any use of it other than for evaluating the game testing;

(b) not disclose or permit any disclosure of the Confidential Information to any third party without the prior written consent of Twice Different. Including:

  • Not streaming, posting or publishing any content from testing game versions which are not publicly available.
  • Discussing the game testing only in the designated testing channels on the Twice Different Discord

(d) not reverse engineer, disassemble, or decompile any prototypes, software, samples, or other tangible objects embodying Twice Different’s Confidential Information;

(e) not use or reproduce the Confidential Information for any purpose except as strictly necessary to perform the Services.

f) not use Confidential Information for commercial advantage without Discloser’s prior written consent.

For the purposes of this clause, “Confidential Information” includes any information in any form (written, visual and/or oral) relating to the business affairs of Twice Different, its intellectual property including without limitation all games and development ideas and materials, information about its licensees and customers, including without limitation all private and personal information held by Twice Different and any marketing, finance and legal affairs of Twice Different, but does not include any information that is widely available to and known by the public (other than as a result of a breach of confidentiality by, or involving, you).
